Aircraft Accident Claims
Increasing numbers of people are travelling by air both on domestic and international services and unfortunately accidents can occur at any stage of the departure/flight/or arrivals process.
Whilst at the airport the operator has a legal requirement to ensure that its premises are reasonably safe for use and free of obstruction or spillages.
Equally the airports internal workings and electrical equipment such as escalators are to be regularly serviced and maintained and passengers are to be provided with a safe passage from the airport terminal and onto the aircraft.
Aircraft steps and air bridges must be securely attached to the aircraft and passenger safety is to be monitored at all times.
Whilst taxiing and once airborne, passengers can be exposed to other risks of injury and therefore the airline carrier is required and expected to go to every possible length to avoid the passengers being injured.
Am I entitled to aircraft accident compensation?
You may be entitled to make a claim if you have been injured in an accident at an airport or onboard an aircraft within the last 2 years. For instance, you may have been burned by the spillage of a hot drink or struck by an item falling from an overhead locker.
Alternatively you may have sustained injury whilst embarking or disembarking the aircraft.
The definition of what constitutes an accident onboard an aircraft is quite a narrow one and for this reason not every claim can proceed against the carrier. There are international conventions in place which govern claims brought against airlines and there is also a strict 2 year limitation period that applies so it is imperative that you don't delay in bringing your claim.
Case Study
We represented a Miss E who made her way through the departure hall of an international airport.
Unfortunately she slipped on a puddle of water in the airport concourse caused by a leak in the terminal roof.
The claim was originally rejected by the airports insurers, but we argued in the clients favour and an offer was later made of £1,750.
