Necessary Details for Road Traffic Accident Claims

Please remember to obtain full details at the scene of the road traffic accident of the driver (or drivers) at fault. These details should include contact name, address and telephone number along with insurance details.

If you have any concerns at all that the offending driver may not be insured or permitted to drive the vehicle then you should report the matter at the earliest opportunity to the nearest police station and please remember to get an incident reference or log number.

If there were any witnesses to an accident then you should also look to obtain their contact details.
Passengers in cars are almost always innocent and free from blame as long they were wearing a seat belt at the time. The only exceptions to this rule are cases where a passenger knowingly accepts a lift from a driver that has no insurance on a vehicle or who may be under the influence of drugs or alcohol at the time of driving the car.

Case Study

Mr S was self-employed and the driver of a motor vehicle when the defendant collided with the rear of the claimants vehicle. Despite initial medical evidence suggesting the claimant had suffered a simple whiplash type injury to his back,  we warned the claimant against early settlement despite initial offers in the region of £2,000.

When the claimant failed to recover as expected we encouraged further medical investigation and despite rigourous opposition from the defendant insurer, obtained evidence to show that the accident had triggered sciatica which could only be resolved with surgical intervention.

The claimant was unable to continue working as part of his family business, and, as a result of a close working relationship with the claimant we fully appreciated the dramatic affect the injury had upon the claimant's life.

Through persistent and authoritative pressure we helped to arranged the much needed surgery at the expense of the insurer and helped the claimant throughout rehabilitation process.

Only once we were satisfied that the claimant was on the road to recovery did we look to recover compensation; securing a payment from the insurer in excess of £250,000.
