Unlike the occupants of a car, motorcyclists are not secured to the motorbike by a seat belt nor do they have the outer body or crumple zone of a car to protect them in a collision. They therefore have greater exposure to the risk of injury through accidents. Unfortunately these injuries can often be serious or even fatal.
Our Experience of Motorbike Accident Compensation
Broadly speaking, we've found there to be several categories of motorbike accidents; motorcyclists can be hit by other vehicles, the motorcyclist can fall off the bike in attempting to avoid other vehicles and the motorcyclist can fall from the bike because of hitting a pothole or some other defect in the road.
If a motorcycle accident has deemed to be caused through the negligence of another driver then the insurers of that other vehicle will deal with the claim.
If a motorcyclist falls from a bike because of the poor road surface then liability (i.e. blame for the accident) may well rest with the council or highway authority responsible for maintaining of the road. Council's also carry insurance for this eventuality, however for this type of claim to succeed against the council it has to be established that they have failed to keep to a regular inspection and maintenance regime.
Case Study
Mr K was riding his motorcycle when the defendant drove his car into the path of his motorbike. Mr K was thrown into the car and his motorbike was badly damaged. The defendant denied responsibility and even tried to suggest the accident never happened.
We obtained detailed evidence and in full support of the client, we issued court proceedings. Under this pressure the defendants insurer paid out over £5,000 to Mr K and paid for the repairs to his motorbike.
