GP & Hospital Claims
Hospitals, GP surgeries and other centres for medical treatment should be clean, well maintained and, as far as possible, safe for use by members of the public and staff who work on those premises.
These premises should be free from contamination or infection and risks of exposure should be kept to a minimum. Such risks should be properly assessed and reviewed on an ongoing basis.
There is a however a risk that when patients attend these areas they can sustain injury in a number of ways. One being for instance that they may are exposed to an avoidable risk of infection or cross contamination.
MRSA Compensation
It has been widely reported in recent years that patients have come into contact with equipment or premises that may not have been suitably cleaned or sterilised prior to use; this can cause a condition referred to as MRSA.
The affects of this condition can be debilitating and it is agreed that a patient has a reasonable expectation when they go into hospital and undergo a procedure that this will make them better.
Hospitals and treatment centres are required to maintain up to date and accurate records of cleaning and sterilisation procedures and they must also conduct risk assessments with the aim of keeping risks of exposure to the condition such as MRSA to a minimum.
Claims against Hospitals & GPs
Other risks patients may come across in these treatment areas are spillages and wet floor surfaces, which commonly occur in hospitals. Floor services should be checked and cleaned on a regular basis.
Hospitals are also under a duty to ensure that visitors and staff are not physically assaulted by violent or drunk patients, and adequate security should be provided by the hospital to ensure that this is the case.
Case Study
Mr G was injured when a hospital porter pushed a trolley into his elbow as he made his way along the hospital corridor.
