Dental Negligence Claims

Dentists, like doctors and nurses, are required to meet a duty of care which they owe to their patients.
Dental treatment is to be carried out to a professional standard and if the treatment falls below this required standard then you may have grounds for making a dental negligence compensation claim.

A victim of dental negligence has a period of three years from the date of incident to lodge papers at court and commence proceedings against the dental surgery. In some cases however, it may be possible to argue that the three year limitation period starts on the date that the victim of the negligence became aware that the treatment given was of a negligent standard.

It is important therefore to establish that the identifiable injury or medical condition arises directly from the dental negligence or malpractice.

The required standard that a victim of dental negligence is required to meet is they must demonstrate that the treatment given was not of a standard which would be provided by a reasonable and competent member of the dental profession.

Our Experience of Dental Negligence Compensation

Dental negligence claims can be made in respect of careless treatment or a failure to diagnose a dental condition. Not only can injury result from the dental negligence but in our experience costs of corrective treatment may arise, and it seems unfair that private-paying patients should have to meet such additional costs.

We have come across cases  with our clients where a patients jaw has been broken as a result of a tooth extraction.

We have also come across cases where clients have attended a dental surgery and undergone hygiene procedures but unfortunately, this has resulted in damage to existing bridges, crowns and fillings through the over exuberance of the dental hygienist; leading to the victim experiencing pain and suffering. Frequently the victim will need to undergo a corrective procedure  or repair work to correct the damage.

Our specialist solicitors can advise you on your entitlement to claim and give guidance on your prospects for success. We will also identify those losses which you may have suffered and which need to be included in the claim.

Case Study

We represent a Mr M. who having seen his dentist, was sent to see the hygienist. The hygienist was over-exuberant with the amount of force she applied and as a result she snapped Mr M's dental bridge causing injury and lasting damage.
