Medical Claims

Doctors and nurses are required to meet a professional duty of care and treatment and medical advice must be provided by individuals with suitable levels of training and experience. High professional standards must always be maintained. However when these high professional standards are not met, then this may give rise to a claim in medical negligence against the treatment provider.

Our lawyers can assist in advising whether or not you have basic grounds for bringing a medical negligence claim. We look to obtain copies of medical records and treatment notes in order to assess the strength of the proposed claim and it is generally advisable that this is done before intimating the claim.

Medical negligence claims (sometimes referred to as clinical negligence claims) can take several years to conclude successfully if there are complex issues involved and  it is important that the level of damages recovered are proportionate to the injuries and losses sustained.

Our Experience with Medical Claims

We assist clients in recovering compensation for injuries which arise out of medical negligence and malpractice. This can include claims brought against Hospitals and GP’s Surgeries, as well as Dental Surgeries and providers of Cosmetic Surgery. The consequences of this type of injury can be life changing. Graham Coffey & Co work closely with their team of medically qualified experts to ensure that we maximise your chances of winning the case and that we recover the highest level of compensation for you.

Case Study

Graham Coffey & Co represented a Miss B of South Manchester who was admitted to her local NHS Hospital for routine surgery to her right shoulder. The surgeon who performed the surgery completed the procedure leaving his theatre assistant to apply the sutures. With the sutures applied, the assistant attempted to remove a surgical drape before placing Miss B in the recovery ward. Unfortunately, the drape had become stuck to her breast and the assistant used a pair of scissors to remove it.

In doing so the assistant cut through Miss B’s breast causing deep laceration and significant injuries. In due course this impacted upon Miss B’s psychological state of health and it also caused her problems at work.

Graham Coffey & Co assisted Miss B in not only securing an admission of liability from the Hospital’s lawyers, but also in recovering an award of approximately £50,000.
