Am I entitled to boat accident compensation?

If a boat such as a canal barge or speed boat is being used for leisure or a sporting activity and is being hired by a novice, then it is important that the owner of the vessel provides a good level of instruction to the user.

This instruction should concentrate on how to handle the vessel and how to avoid accidents and potential injuries.

If the equipment is hired out just for leisure purposes, it must also be adequately maintained and in a good state of repair. Specific instruction should also be given as to how best to avoid accidents involving innocent third parties such as swimmers or other boat users.

A cross channel ferry must be fitted with items which facilitate passenger safety such as handrails and non slip floor surfaces. Passengers travelling by boat must be adequately drilled in evacuation procedures and supplied with emergency life jackets and other flotation devices.

Holidaying onboard a cruise ship is becoming an increasingly popular choice but injury can occur onboard. If you book a cruise through a travel agent or tour operator then the package travel regulations will apply and this enables the injured party to claim for an accident which occurs overseas through court in the home jurisdiction i.e. England and Wales.

Please be aware however that you may only have 2 years in which to bring your claim against the shipping company, and therefore you should make your claim as soon as possible.
